Terms of Service

1. Acceptance of these terms
These Terms of Service ("Terms") govern your access to and use of Brand OS, a service operated by Space Co ("SP-CE", "we", "us"), a company operating in the United States and Canada, together with its websites, applications, and services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. The Service
Brand OS is a brand operating system. It stores a company's brand strategy, voice, guidelines, and templates in one system, generates first drafts of marketing assets from that foundation, and audits assets against the brand guidelines. Brand systems are loaded and maintained by the SP-CE team as part of onboarding and ongoing service.
3. Eligibility and accounts
Brand OS is offered to businesses, and accounts are provisioned for clients by the SP-CE team. You are responsible for keeping access to your account secure, for all activity under your account, and for the accuracy of the information you provide. You must be at least 16 years old and authorized to act on behalf of the organization you represent.
4. Your brand materials
You retain ownership of the brand materials you provide — strategy, guidelines, templates, and assets — and of the drafts and assets generated for you. You grant us the rights necessary to store and process those materials to operate the Service, including processing by the third-party model providers we use to generate drafts. You represent that you have the rights needed to load the materials you provide.
5. Acceptable use
You agree not to:
- use the Service with brand materials or assets you do not own or are not authorized to use;
- attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service or its systems;
- use the Service in violation of any applicable law or third-party rights;
- resell, sublicense, or misrepresent the Service or its outputs.
6. Intellectual property
The Service, including its software, design, and content we provide, is owned by us and our licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes.
7. Generated content and accuracy
The Service relies on third-party large-language-model providers to generate drafts. Generated content is a first draft, not a finished deliverable: you are responsible for reviewing assets before publishing them, including for factual, legal, and regulatory accuracy. Brand scores and audit results are directional indicators, not guarantees of consistency, quality, or business outcomes.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any output or recommendation will achieve a particular outcome.
9. Limitation of liability
To the maximum extent permitted by law, Brand OS and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months preceding the claim, or, if you paid nothing, one hundred US dollars.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends, and we will handle your data as described in the Privacy Policy.
11. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the date below and, where appropriate, notify you. Your continued use of the Service after an update means you accept the revised Terms.
12. Governing law
These Terms are governed by the laws of the state or province in which Space Co maintains its principal place of business, without regard to its conflict-of-laws rules.
